As the accompaniment of international trade, dumping and anti-dumping have long been the focus of theories and practices of international economic law. Early in the 20th century, many countries legislated the Anti-Dumping Law in succession to punish the act of dumping, to eliminate its harm and to protect domestic industries. For the purpose of coordinating the conflicts of anti-dumping regulations in each country, the anti-dumping regulations were originally stipulated in the sixth item of General Agreement on Tariffs and Trade (GATT) which went into effect in 1948. The agreement of anti-dumping was reached as the result of several multilateral trade negotiations thereafter. Thus the modern international anti-dumping legislation came into being. World Trade Organization was determined to set up in the Uruguay Round Negotiation from January of 1987 to the end of 1994. Meanwhile a series of law texts were made. Finally WTO Anti-Dumping Agreement was reached. This agreement is now playing a pivotal role in terms of international anti-dumping regulations. And it is said to be the kernel of anti-dumping international legislation. The Agreement consists of three parts and two appendixes. The first part that discusses the substantial regulations of anti-dumping is the core of it. And the first part can be divided into two aspects, i.e. substantial regulations and procedural regulations of anti-dumping. The substantial regulations or the confirmation to the dumping is the kernel of the first part. For the sake of researching deeply as well as the length of the writing, this thesis will just discuss the confirmation to dumping ~ the kernel of the key parts of WTO Anti-Dumping Agreement.
