A Study On The Legal Problems Between The Irtms And Trims Under WTO Circumstances

With the development of world economy, globalization has been changing rapidly from dream to truth. Especially for the hard working of WTO, many countries have affixed to numerous multilateral treaties, which include trade in cargo, trade in service, intellectual property etc. And at the same time, the problems arising from the foreign investment make the developed countries bring the investment measures into WTO circumstances. These have supplied the economic exchange between the developed countries and the developing countries with more internal power and better external environment. But due to the economic and cultural difference, the understanding and actualization of the trade measures and the investment measures confronted with some contradictions, and many developing countries often treat the two isolated, which bring them troubles. The thesis tries to grasp the mutual relation and impact between the trade measures and the investment measures and makes a study on serial legal problems.The first chapter introduces the rules of the trade measures and the investment measures under WTO circumstances and generalizes their concepts.The second chapter analyses the legal relation between the trade measures and the investment measures and other relevant themes, which lay a foundation for the next study.The third chapter concerns the impact between the trade measures and the investment measures and the author points out that their impact plays an important part in the future of WTO.The fourth chapter gives a brief introduction to the trend of legislation between the trade measures and the investment measures and the author hopes that it can bring us some experiences for reference.The fifth chapter discusses the influence of the rules of the trade measures and the investment measures under WTO circumstances to the enactment in our country. The sixth chapter sums up the whole article and makes a few suggestions.
