The rise of the electronic commerce is challenging the traditional law system. Especially as respects to the civil case law questions, such as the electronic offer and accept, the legal effect of the electronics contract, identification of the contracting parties, and the revenue from tax concerning electronic commerce. Currently the developed and some international organizations have set up some sets of electronic commerce codes continuously. And our country just starts to regulate the electronic commerce, but we have made quick progress. The (( contract code )) describes generally the making process of electronics contract. But (( electronics signature code )) put forward recently provides the essential legal bases for the identification of the electronic commerce parties. But the legislature of electronic commerce in China is still far from being perfect. So the author compares the electronic commerce legislature of the different states and international organizations, and finally on the basis of Chinese electronic commerce practices the author put forward several suggestions for the benefit of the further development of China' s electronic commerce.
