Studies On The Influence Of Agreement Of The IMF On The Legislation Of The Foreign Exchange Control And The Countermeasures In China

This dissertation introduces the historical background, the birth and the revisionsof the Agreement of the IMF and takes one part of it-the foreign exchange controlas its starting point. By introducing the articles about the foreign exchange control of the Agreement of the IMF, it sets forth the meaning, characteristics and forms of the restrictions on the current account and the controls of capital account and analyzes the influence of the foreign exchange control from economic as well as legal aspects.Because the Agreement of the IMF is practiced in the members of the IMF, the dissertation introduces the influence of it on the legislation of the foreign exchangecontrol from two aspects-the restrictions on the current and the controls of capitaltransfer, this is one of the keys of the dissertation. It introduces several typical countries' legislations of the foreign exchange control and systematically classifies the legislations of it. By means of comparison, the influence of the articles about the foreign exchange control of the Agreement of the IMF will appear. At the same time, it also introduces the birth, the development, the characteristics, the legal system of the foreign exchange control of China and the challenges she's facing and puts the emphasis on the difference about the legal system of the foreign exchange control between China and the Agreement of the IMF, pointing out the way to completing the legislation of the foreign exchange control of China after the entrance of the WTO.The dissertation sets the legislation of the anti-monetary laundering as a single charter, trying to completely describe the system of the foreign exchange control. People used to think the legislation of the anti-monetary laundering was only the matter of the criminal law, neglecting its important function on completing the financial legislation. The legislation of the anti-monetary laundering is one of the most important powers to complet the legislation of the foreign exchange control.The last charter, Suggestions on completing the legislation of the foreign exchange control in China, is the main achievement of the dissertation, in which the author points out the importance of creating the Foreign Exchange Law and gives some suggestionson rebuilding the current legal system of the foreign exchange control on the basis of it. At the same time, because China doesn't have a systematical legislation on the anti-monetary laundering, the author also gives his own suggestion on creating the Anti-monetary Laundering Law and the legal system of the anti-monetary laundering of Chinese characteristic.
