One of the most important problem in the Chinese foreign trade legal system is how to ensure the origin of the imports and exports goods, one of the fundamental tasks of the world trade organization is to establish an international origin of goods judgement standard that can be accepted by the most countries, and also, this standard can not only be apply to the most-favoured-nation clause ,account restrict, custom stat, anti-dump, anti-subsidy and guarantee measure so on, but also can be apply to the original mark, property right of knowledge and government stock.The State Department promulgated the origin of export & import goods' ordinance of the People's Republic of China in sep 3rd ,2004. It is the first subdivision non-favorable administration law about the import & export goods after China's entry into WTO . The adjustment , improvement and consummation of the ordinance will certainly advance the exertion of the regular for the origin of goods and also promote the development of Chinese foreign economic trade.The legal protection of the origin of goods has a history over 100 years, and also had come into being a comparely self-contained legal system.
