On The Import And Export Policies Of Financial Institutions Legislation To Improve

Legislation for export-import policy financial institutions is still in absence in our country. On the 12th anniversary of the Export-Import Bank of China, the relevant legislative system is only a framework includes nothing but Decision of the State Council on Reform on Financial System promulgated in 1993 and some other regulations. This situation of lagging Legislation does not meet demands required by our fast economic development, ever-expanding international trade and external communicating of our government. Up to now, specific Legislation on the said issue remains unaccomplished, as a result of which the nature and developing direction of Export-Import bank and export credit insurance company are still unclear on point of law. Due to the absence of explicit legal orientation, intention of policy can not function fully and properly. Therefore, it is grave as well as urgent to constitute and consummate legal system of Export-Import policy financial institutions.In this dissertation, the author at first gives a concise introduction to definition and legal characteristics of export-import policy financial institutions, and then retrospect ting briefly the course of the reform on import and export financial policy in our country, the author pay more efforts in analysis of deficiency of legal orientation of export-import policy financial institutions in our country and its cause of formation. In the third place, through the comparing between the relevant legal systems in several developed countries and relatively developed countries, this dissertation is trying to analysis the characteristics of legal orientation of export-import policy financial institutions in other countries and their experiences thereof which may be used for reference. In the end of this dissertation, the author concludes suggestion on reform and legal improvement of export-import policy financial institutions in our country referring to such aspects as its nature and legal status, its function and scope of business, its establishment and arrangement of organizations, etc. From the view of the author, it really makes signifying sense to administrate legally export-import policy financial institutions and to improve its legal framework for the sake of realizing harmonized development of social politic-economy and constructing the harmonious society.
