A Study On WTO Antidumping Law And China's Countermeasures

China has already entered into WTO formally, which meant our country should be engaged in the international trade activity according to the rule of WTO. But because the trading company of our country can not know clearly the relevant laws on dumping and anti-dumping, especially can not deeply comprehend the anti-dumping rule and the dispute solution mechanism of WTO, the anti-dumping cases of our country increase day by day in the world. This has seriously influenced the normal trade of our country and trade image of our country in other countries (districts). So after China has already entered into WTO, it is the realistic choice for the government and export enterprise to carry on the anti-dumping agreement of WTO and adopt the positive actions in competing and responding to action. Just because of the above purposes, this article thoroughly analyzes the legal system of WTO anti-dumping, then proposes the corresponding measures of our country.This article amounts to more than 36,000 words, which divides into four parts. Part â…  looks mainly back to the historical evolution of legal system of WTO anti-dumping, and emphatically analyses the new development that was acquired in all previous rounds negotiation. Part â…¢ firstly analyses national theory of the non-market economy and the limitations of public interests clause, accumulative assessment clause, injury determination clause, causality determination clause and anti-dumping lawsuit clause in terms of macroscopic, then analyses ambiguous meaning of key words of like product domestic industry and regional industry in anti-dumping legal system of WTO from microscopical aspect. Part â…£ discusses government's corresponding measures to international anti-dumping from the following four aspects, that is, structuring the fair legal environment of international anti-dumping, structuring an all-round way, healthily and orderful economic system of domestic market, giving full play to the role of employer's organization and, structuring an support mechanism of responding to anti-dumping action, at the same time fully expounds enterprise's corresponding measures when export products are encountered with anti-dumping investigation from the microscopical aspect.
