| Credit Checking or Credit Investigation is one of important technical terms in the credit management theory. It refers to the professional investigation into the consumer credit and business credit, which includes verifying, collecting, offering, maintaining and spreading the credit data concerning the credit dealings. To begin with the analysis of the credit crisis in China, by using the theory of Jurisprudence of Economic Analysis and Comparative law, the thesis tries to probe into the obstacles confronted during the process of establishing the credit checking system in China. And it points out that the sound Credit Checking legal system plays an important role in promoting the credit system, regulating the activities of the market entities and facilitating the market economy in China.There are three parts in this thesis,The first part: credit dealing and credit checking. To begin with the most foundational concept in the credit management theory i.e. "Credit", this part indicates that there are disadvantages in the credit dealing which need to be regulated by the credit management system. As an important branch of the credit management system, credit checking is a very useful way to control the credit risk and keep the market in good order.The second part: The credit crisis in China and the status in quo of China's credit checking system. This part firstly stipulates the harm brought by the credit crisis by using the facts and data. Based on the analysis of the reasons for the credit crisis, it also demonstrates the necessity and impendency of establishing the credit checking system in China. Then this part proceeds to the obstacles confronted during the process of building the credit checking system in China and the lagged legislation concerning credit checking hinders credit information industry from going ahead.The third part: Some advice on perfecting legal system of credit checking in China.To compare one credit checking mode in foreign countries with another and use the experiences of the legislation concerning credit checking for reference, this part puts forward some advice on the legislation of credit checking in China. |
