Study On Trade And Environmental Problem Of Developing Countries

With the arrival of the economic globalization , the contradiction between environmental protection of liberalization and free trade is more and more conspicuous, meanwhile, trade and environmental problems have worldwidely caused the extensive concerns. Though developed countries are advocates and pushers of international environmental protection movement,but to developing countries, the environmental problems that caused by the liberalization of trade should be far more than developed countries'. On one hand,developing countries need trade development to drive the economic growth urgently, the liberalization of trade has already become the indispensable factor of developing countries' economic development; on the other hand, Accompanied with the environmental pollution transferred from the developed contries, even with a terrifying environmental contamination, a enormous environmental cost is also hidden behind trade development in developing countries,especially on the initial stage of their development. As the biggest developing country, China is also bearing above mentioned environmental pressures in foreign trade. It has positive theoretical and practical significance to probe into the settlement of problems of developing countries' trade and envionment,which can coordinate the relation between trade and environment problems of our country while improve the legal system of environment of our country for taking the road to sustainable development. Based on the actual conditions of developing countries and started with the developing contries's environmental problems caused by trade development,this text, through the discussion of the reason of environmental problems and the substance of relation between trade and environment, is intentional to illustrate that the developing contries can neither follow the old model of " manages after polluting" nor become the "paradise" of developed contries' pollution transferring. The key of settling developing contries's environmental problems lies in the internalization of environment cost by legal, administrative and economic methods, meanwhile the environmental control should be put on those trade activities which are harmful to ecological safety, public health. What mentioned above is aiming to provide a reasonable way to coordinate trade and environment of developing contries, to provide sensible advices for the completion of our contry's environmental legal system and guarantee the trade development of our country by detailed analization and elaboration of this article. The research of this text regards such disciplines as law science, sociology, ecology, economics, international trade,etc. as the perspective of analyzing, method of using positive jurisprudential analysis, comparative analysis, historical analyse synthetically etc. Based on actual facts, advanced experience of other countries and fundamental realities of China and other developing counties have been taken into account in the course of writing this article with attemption to offer actually significant advices and suggestions. The positive results of the research will offer scientific theoretical foundation for the settlement of trade and environmental issures and the completion of environmental legal system after entering the WTO.
