| Construction are highly developed in China in recent years, but with no effective system of surety guarantee and system of risk transfer to restrict actions of owners and constructors to elude risk, lots of problems as bad quality and non- payment, especially in performance of contract come forth. Construction surety bonds is an effective credit instrument to guarantee the performance of a construction contract in the international project risk management and it's also a common approach in the international building at the same time. So the research on construction surety bonds has importantly academic and realistic meaning and broad prospects of application.The research work done by the author was illustrated as below:(1) From the concept of construction surety bonds, it discusses the mode and law propriety of construction surety bonds. The paper mainly analyses the info-dissymmetry principle and points out that the surety bonds is the only mode to be adopted according to the surety law in China construction.(2) The dissertation founds the basic frame of construction surety guarantee system from the foundation in law of Construction surety bonds, the mode of construction surety bonds, contract of construction surety bonds, the flow of construction surety bonds, and so on.(3) The dissertation detailedly expound construes realistic conditions in China and actions of Chinese government in practicing construction surety bonds. Combining with species, modes and materially personal experiences of construction surety bonds in abroad, the paper concludes that besides executing the bid bond and the performance bond, the employer payment bond should be put into practice with the pratical conditions in China.The application theory and the operation mechanism of the Construction Surety Bonds system researched in this dissertation may serve as a direct instruction to practical Construction Surety Bonds. Therefore it is not only important in theory but of valuable in practice too.
