A Comment On The Research On Administrative Monopoly And Legal Regulation Of Anti-trust Law

Administrative monopoly, one of important society problems in the transferring period in China, has become the obstacle of the development of Chinese economy and more and more people notice and denounce it. It is one exceptional society phenomenon that has diverse forms and complicated causes. The main purpose and train of thought: detailing comprehensively and analyzing deeply academic circles' comment and research on the causes, background, styles and the harm of administrative monopoly, including the design of related legal system of anti-trust law. Then the author ponders the shortcoming on above and gives analyses on it gradually. Ultimately the thesis tries to provide apt thinking and recommendation.This thesis consists of four parts. The first part ponders the concepts and the forms of administrative monopoly given by academic circles, trying to make rational definition. The second part illustrates detailed viewpoints of academic circles on harm and reasons on administrative monopoly. Based on the illustration, author gives diagnosis and proposition. The third part ponders and analyses the research advancement and diverse outlook on anti-trust legal regulation on administrative monopoly. Based on the introspection of the study status of academic circles, the fourth part gives a suggestion on anti-trust legal regulation on administrative monopoly. Simultaneously, the author points out that we should have a foothold on the transferring period and transitional background in China. Synthetic methods, including anti-trust law, administrative law system, structural reforms, should be used to restrict and resolve effectively the issue of administrative monopoly.
