A Study On Legal Cases Of The Credit Asset Securitization

The asset securitization, evolving from U.S.A., is a new financing way adopted extensively by countries all over the world in recent years. With the advantages of structural financing, it brings new function of borrowing money. More and more countries adopt this way to carry on financing. In such background, our country is launching the pilot work of the asset securitization of credit, basing on our environment. People's Bank of China and Bank Supervisory Committee have issued relevant financial rules together. The circle of theory has carried on great concern to this, mainly about the questions such as concept, necessity and feasibility etc. This paper pays attention on the concept of asset securitization and the legal theories. At the same time, this paper also focuses on the experience of foreign countries, in order to supply something active to our country. After the above analysis, the author wants to give some useful suggestion of improving our law system.This paper divides chapter three and launches narrating. Chapter one mainly involves the cause, define and the function of the asset securitization. Chapter two, paying attention on analyzing the general legal principle of the asset securitization, has investigated practice of our country and current legal provisions in chapter three, and has put forward the suggestion for the completion of the legal provisions. Among them, chapter one is a foundation of the paper. Chapter two, about the theory analysis, mainly serve for proposing and solving the problem in chapter three.
