A Study On Judicial Interpretation Of China

Judicial interpretation is a law special concept only exiting in China. During the process of constructing law-governed society, the importance of it can not be neglected. It has become illegal since it borne, for loading too much task. Collecting, discussing and analyzing the judicial interpretations, is the topic of this article.The article consists of four small parts. The first is the introduction, which briefly delineate chapters the position and function of the judicial interpretation in legal system and find out its problems. In the second part, this paper provides an explanation, analysises the judicial interpretation with the concept, and defines the judicial interpretation. According to this definition, for further understanding/knowing the judicial interpretation, it is necessary keneficial to explore it's nature and charaters judicial and hermeneutic innate characters. The fourth part argues about judicial fulfillment present conditions that explains and reviews its disadvantages, current function's inadeguacy and so on. The bringing of realistic problems and the defination, system concerning problem, is part for the third to afreshly construct or purchase the judicial interpretation to provide the necessity but sufficient preparation, therefore, at the right fixed position that the main solution is a judicatory to explain, explaining the principle's establishment, and through enhancing the saying of judicial decision.For the limitation of my capability ,the description of the article has to base on others results.
