In the modern society emphasizing on information and democracy, the news and stories produced by mass media are increasingly involving in privacy, which usually leads to unhappiness and dissensions. There are some reasons that lead to the conflicts between the right of privacy and the right to know: the inconsistency between the irrational factors in people's desire for know and the require to control one self's information; the indraught of media capital which made journalism change; the conflict of conception; the open of democratic society; and the panlogistic on the right of privacy.The right to privacy is protected by laws, at the same time, the realization of the right to knowing the inside story also need mass media' help. So we need to find a better way to balance the relation of the right to privacy and the right to know.Having analyzed the reasons of the two rights' conflicts, this article analyzes representative cases on the right of privacy in American, in order to find the reasons and the tropism of value in the backside, and hopes to reach some useful means to solve the two rights' conflicts.This article also expatiates a viewpoint that laws are not the only way to resolve the conflicts, and not all verdicts get balance. Therefore we need moral criterion to balance the relationship of the two rights, which need mass media and public's self-discipline and maintenance. Although in different society, for different person, the comprehension of the two rights, we can use five principles to balance their relationship, which are public benefit, keep secrets, illegal privacy, uppermost personality and subjective fault.
