A Research On The Competency Of Evidence

This essay is titled with A Research on the competency of evidence. The first chapter gives an analysis of the essential elements of civil evidence competency, comes up with a new point of view on the objectivity of evidence. It holds the view that the objectivity of civil evidence means that the evidence has its own message that can not be casually interpreted. It is in this sense that the objectivity makes the substantial character of evidence that marks the difference of modern evidence institution and ancient ordeal. The second chapter discourses upon the evidence admission principle. The third chapter deals with the principles concerning the judgment and sift of evidence. The fourth chapter analyzed the several legal forms of evidence and their concerning rules.After a comparison of evidence legislation and administration of justice of different countries, this essay deals with the flaws existing in China's evidence legislation and administration of justice concerning the competency of evidence, and puts forward some tentative suggestions.
