Administrative Franchise means distributing resources by administrative power. There are many typical cases in the reality. The law of administrative licensing has stipulated the item of franchise. The perfect system should possess the normal legal form and distribute resources effectively. This text has examined the the system of franchise of our country. We find that the system can't dispose resources effectively. This text proposes the suggestion that the system should possess the character of public law and private law. Firstly, we should use two means. Secondly, we should protect public interests and private interests. Thirdly, we should set up the system that possess the character of public law and private law.
