With the development of scale of high education in our country, the function of organization and compulsion of educational administrative management of college and university becomes more prominent and has great influence on educational quality and development. An objective request is put forward to the administration management because of awakening of consciousness of individual rights, establishing of modern educational value and quickening of developing process of society. The paper emphasizes on analyzing the trouble of ruling administration by law in college and university of our country, and brings forward that the law should clearly states that the college and university should be administrative subject authorized by law, therefore the educational law suit of college and university is brought into the administrative law suit.
