Research About Redress Systems For Labors'Industrial Injury

There are two main redress systems that are tort injury compensation system and industrial injury insurance system when labors are injured. At the beginning of the industrial society, traditional tort injury compensation system was always acting as a main role on the employment injury occasions. But along with the development of the industry, industrial injuries aggravated. So traditional tort injury compensation system was hard to deal with this. It was a good opportunity for new systems to come out. Then industrial injury insurance came out and was becoming the main measure redressing those injured labors instead of traditional tort injury compensation. So I have to think about the applicability of those two systems. How to make a choice is related to lots of factors such as law theories, society interests and economic conditions etc. So different countries have to make their own rational choice based on native conditions.This article is made up of four parts:Chapter one is about the characteristic and the background of the industrial injury, which make me get the motivation and the consideration. The motivation is the unavoidable injuries. The consideration is that the development of the injury caused the evolution of the redress system from traditional tort injury compensation to modern employment injury insurance.Chapter two is about traditional tort injury compensation. First, because the compensation for breach of contract was not available, tort injury compensation became the main redress way when the industrial society was forming and developing. Then I discuss the tort injury compensation about its producing background, imputation principle and the influence of liability insurance.
