On The Legal System Of Rural Land Trust

With the in-depth market economy, the rapid development of agricultural productivity, and particularly the impact of foreign agricultural markets on our agriculture with the entry of WTO, the current mode of small-scale operation of agriculture by peasants doesn't meet the need for agricultural development, which is in the urgent need for large-scale and professional operation. So the use rights of rural land should transfer freely between the different business entities. At present, the use rights of rural land includes subletting, lease, transfer, and other forms, which can solve agricultural issues effectively to a certain extent. However, they don't solve the problem thoroughly. Because there are all kinds of problems of their own, the practice in the southeast coastal areas shows that the land trust is an effective system in transferring of the use rights of rural land, which should be promoted nationwide. The land trust system can effectively solve problems about the rural lands, be helpful for large-scale and professional development of agricultural production;furthermore, it can make the limited land resources in the rural area utilize fully and effectively, which can improve the rural household contract responsibility system and promote the development of rural productivity.The article combines theory with the rural status quo in China, it analyzes the necessity of the transfer of use rights of rural land, and details the concept, identity and operating mechanisms of land trust. At the same time, it also makes the objective and details exposition feasibility and complementary measures for the land trust.
