As far as the financing cost of securitization is concerned, tax constitutes the biggest sector, which takes a great part in the development of securitization. Due to this, the taxation legal system is scientific or not directly decides the success and prosperity of securitization. In the thesis, the author studied and made suggestions on the issues of establishing and improving Chinese taxation legal system of securitization through comparing, analyzing and putting theories into effect. By doing this, the author wished to do a little favor to the development of securitization in China.Chapterâ… starts from the conditions of Chinese taxation legal system of securitization executed at present, analyses its legal nature and reveals that it has low legislative level, weak force adeffect, invalidity and other defects.Chapterâ…¡introduces the taxation legal systems of America, U.K., Japan, Italy and Taiwan (China) related to securitization, aiming at using them as reference in the process of establishing and improving Chinese taxation legal system of securitization.Chapterâ…¢mainly researches on issues, such as the juridical relation related to securitization, the lodestar, principles and strategy adopted in the process of legislation, how business tax influenced by the way of transferring assets, sponsor's income tax credit and advance payment of income tax in order to establish a theoretical foundation for Chinese taxation legal system of securitization. Chapterâ…£makes suggestions on the components of Chinese taxation legal system of securitization, such as income tax law system, turnover tax law system, conduct tax law system and property tax law system by combining the characteristics of securitization to Chinese taxation legal system.
