Theroy Divorce Moral Damage Compensation System

Current Marriage Law is amended on the basis of the Decision on the Amendment to the Marriage Law of the People's Republic of China at the 21th Meeting of the Standing Committee of the Ninth National People's Congress. The system of compensation for damage in divorce is a new emendation for divorce that is established by the current revised Marriage Law in China. Divorce due to the domestic violence, bigamy, cohabitate outside marriage, maltreat and abandon family members will lead to economy and spirit damage to the aggrieved party. In fact, the physical and mental injury of the aggrieved party exceed the property loss that can be accounted. Here, the meaning of the system of compensation for damage in divorce to the aggrieved party is the right of moral damage compensation. The law establishes the new damage compensation jin order that the unerring party in marriage shall have the right to claim from the other erring party when they divorce. The aim of the law is directly to protect the stability of the family and indirectly protect the stability of the society by punishment.This thesis focuses on the right of spirit damage in divorce, and sets forth the constitutive requirements of tort liability in divorce based on the concept and characters of the right. At last, this thesis gives some advice on the system of mental compensation for damage in divorce.This essay systematically sets forth the ranges, legal adoption and other relative issues of divorce damage compensation in our marriage law.
