A Review On Feminist Jurisprudence

Feminist jurisprudence is the inheritance as well as the critique of traditional legal theory. The unequal relation between two sexes is the source of feminism. The awareness of human rights promotes the development of feminism. Feminism always focuses on law, because law not only reflects the unequal relation between men and women but also constructs, underpins and maintains the unequal relation. Nowadays, Feminism jurisprudence has become an important school. It not only strives for creating new legal theory, but also makes every effort to let the theory become institution. Comparing with traditional legal theory, feminist jurisprudence is characteristic. In respect of content, it pays attention to studying sex, especially makes a difference between sex and gender. In respect of method, it pays attention to women's perspective in order to find how the law ignores women's experiences and interests.Feminist jurisprudence is not a united system. In order to make a clear appreciation, we must survey its internal arguments. In this article, I class feminist jurisprudence into four categories primarily according to philosophical principles. They are liberal feminism jurisprudence, Marxist feminism jurisprudence, radical feminism jurisprudence and difference feminism jurisprudence.
