Research On The Administrative Hearing System Of China

The system of administrative hearing is important in the administrative law. It advances the legality and rationality of governmental administration, ensures citizens to administrate the country and protects the rights and interests of individuals and organizations. There are several laws and codes formulated with administrative hearing in our country. According to these regulations and the practice, this article probes the important issues in administrative hearing of China.This article interprets the concept of administrative, clarifies the inevitability of administrative hearing system through studying the development of it and analyses the functions of it. The second part talks about hearing systems of three countries. In the third part——the section of systematic analysis to the administrative hearing system of our country, the article concretely studies several issues. At last, this article talks about some ideas about how to perfect Chinese hearing system by combining hearing practice, such as the establishment of principles, the expansion of applying scope, the consummation of president and participators, the perfection of procedures and the intensification of notes. Especially, this article brings forward that we should establish the double―track system in management of president, and makes clear the qualification, authority and duty of them. I wish all of these could contribute the development of administrative hearing system of China.
