The Basic Problem Of The Administrative Hearing System For A Comparative Study

Administrative hearing procedure is central system of administration procedure systems and it is a task, which is full of theoretical and practical values and involves a series of basic theory and practical problems. It was discussed about four problems: administrative hearing procedure orientation, value tropism, and the scope of application and independence assurance of hearing compere. As to administrative hearing procedure system orientation, it not only provided a definite conception but unveiled essence and laws from the deep level. In the discussion of the value tropism of administrative hearing system, it pointed out that the elementary impartial model should be chosen in the present phase. As to the scope of application of administrative hearing system, a hypothesis was put forward. In the analyses of independence assurance system of hearing compere, we should adopt the dual system.
