The Commentary On Legal Status And Practice Of Multinational Company's Codes Of Conduct In China

As an outcome of globalization, the Corporate Social Responsibility Campaign has a great effect upon the economies and the social system in China. But, the Corporate Social Responsibility Campaign is in a state of nonintervention and has no legal supervision, at the same time, labor law system doesn't include the multinational company's(MNC ) Codes of Conduct(COC ), which is great influence on Chinese economies and society. The MNC's COC is an interior Regulation, a positive product of the Corporate Social Responsibility Campaign, and a commitment to take the social responsibility. However, the COC will become a piece of plain paper, and turn into a tool of Public relations and trade protections if without effective supervise and constraints, So the Corporate Social Responsibility Campaign and the Campaign of COC must be absorbed into our country's labor law system. This thesis analyzes the COC's legal nature to reveal the COC's legal validity and then present my concrete proposals about how to absorb COC into our country's labor law system, which on the basis of investigation to the COC's effect upon economic development and legal framework into our country.The main originality in this thesis include: At first, through the analysis of the COC's legal nature, the thesis points out that the COC has its inward nature and outward nature. The COC has widespread influence because of its outward nature. The second, the thesis considers that the COC's legal validity is MNC's moral advantage, Strong economic power and political support from developed country. In addition, the thesis makes a comparison between the some COC files and Chinese labor law, hope to find out the same point and the conflict of them .Undoubtedly, the research into the issue of the Corporate Social Responsibility Campaign or COC from the viewpoint of labor law has significant practical value, especially in a poor situation about worker rights protection in my country.In the meanwhile, nowadays the labor legal system has huge mission on reformation in China, so the research has the certain academic meaning to show clearly the road of labor law system reformation in the background of globalization. Moreover, as a newly-emerged thing, COC is not popular in our county, it will be another Contribution of this thesis if people become familial with COC.
