The Legal Research On Supervision And Management Of The State-owned Assets Drain In Reform Of The State-owned Enterprises

State-owned assets are foundations of national economic development of our country, and are also the important pillar for the growth of the national economy. Currently, the system transformation and the structural adjustment of state-owned enterprises have already stepped into critical stage, some inner problems have exposed accordingly. Among them, the drain of the state-owned assets is an outstanding problem of the national economic development and the state-owned enterprise reforms. The statistics show that since the 1980s, the drain of the state-owned assets has already mounted up to 1600 billion yuan, the amount of average annual drain is about 50 billion yuan, and it accounts for 19.5% of the national fiscal revenue. In fact, the problem on the drain of state-owned assets has already existed at the beginning of the state-owned enterprise reforms, and it is always the hot issue and focal problem during the course of reforms. Although the 16th National Congress of Communist Party of China has proposed the general requirement for reforming management system of the state-owned assets, the overall frame of the management system of the state-owned assets is still not defined.The legal adjustment of the state-owned assets is a great question for study and discussion with which any country has to be confronted.
