Research On Telecom Market And Competition Law And Regulations

Remarkable development has been achieved since the breaking of monopoly and introduction of competition in our telecom market. However, along with the distinct trend of tremulous development in telecom industry, a large number of conducts which disturb the efficiency of competition still exist, and dissatisfied reply from customers increases rapidly in these years. Root cause of above phenomenon can be analyzed and concluded as followed. First, there aren't sufficient competitors in market, e.g. only China Mobile and China Unicom in current mobile market, and in fixed market, although it has been separated into two parts geographically, China Telecom and China Netcom have seized most of the business in their own regions. Second, telecom regulation department which takes the responsibility of regulating telecom market is not independent and efficient enough. Last but not least, existing law and regulations cannot take the burden to manage the telecom market. In China, there's 'Telecom Ordinances' in this field only, with no Telecom Law nor Antitrust Law, which results in powerless legal support when telecom regulation applies its own rights.Focused on what mentioned above, this paper analyzes current situation and issues in telecom field in China, and convergence degree by applying Herfindahl-Hirshmann Index Index, and concludes stages of competition in telecom market from experience of developed countries. At last, through the research on some examples of the relationship of telecom market development and legislation on competition in foreign countries, we summarize their experience and failure, and goes to further discussion on legal environment required for good development of telecom market in our country.We should pay special attention on below illuminative issues in this paper, including consideration on how to set up healthy legal system from telecom development point of view; three stages of competitive development of telecom through analysis of developed countries, and especially the third stage that our own market will be at soon, at which more weight would be put on combination of enterprises and capital operation; research on legal environment necessary for healthy...
