Debating About Constructing Chinese Reorganization Procedure

In the process of developing and changing of law, the phenomena of absorbing and assimilating each other in the legislating field is obvious and popular, first of all in the field bankruptcy law, Chinese bankruptcy law is being reformed. When we transport the Reorganization Procedure, because china lack the experience of executing Reorganization Procedure and is short of theory, we should assimilate the system according to Chinese state situation .Through analyzing Chinese background including condition of economy and society which are developing ,we establish our own Reorganization Procedure with Chinese special traits ,the Reorganization Procedure could be rooted in Chinese field and grow up, the Reorganization Procedure could play its actual function.In my paper, I have a try to analyze the reorganization procedure by describing and appraising it, and then establish Chinese own reorganization procedure with Chinese special traits by absorbing and assimilating foreign law according to Chinese actual situation. I hope that I can provide a suggestion to draw up Chinese bankruptcy law and promote Chinese legislating by writing the paper. China has joined in WTO and merged into the global economy. I expect that we could legislate a new marketing and modernizing bankruptcy law in the new century.
