Research On My Country's Pre-reorganization System

As two ways to rescue distressed enterprises,in-court restructuring and out-of-court restructuring have huge advantages,but their disadvantages are gradually exposed in practice,which can not fully realize the purpose of rescuing distressed enterprises.Under this background,pre-reorganization system arises at the historic moment.The pre-reorganization system absorbs the advantages of in-court reorganization and out-of-court reorganization,abandons the disadvantages of both,and forms a bankruptcy system with low cost,high efficiency and small negative impact on enterprises.Pre-reorganization can stimulate the vitality of market subjects and meet the needs of market economy development.As a new relief system that can help distressed enterprises to revive,pre-restructuring system ADAPTS to the needs of diversified withdrawal mechanisms of market subjects.This paper takes pre-reorganization system as the theme and fully reveals the value of the existence of this system.On the basis of drawing lessons from foreign mature pre-restructuring mode and combining with actual national conditions,this paper proposes a pre-restructuring system program design suitable for China's national conditions,and expounds the problems that should be paid attention to during the construction of pre-restructuring system.
