Discussion On System Of Bankruptcy Administrator

With further deepening of our socialist market economy, births and terminations of various economic subjects including legal entities and other organizations happen more frequently, so does their bankruptcies. It is an urging question to regulate bankruptcy behavior, to vindicate social stability and to fulfill justice in dealing with bankruptcy affairs of economic subjects. The bankruptcy administrator plays an important role in bankruptcy procedure. Whether or not the procedure of bankruptcy can proceed fairly, orderly and efficiently has direct connection with the perfection of system of bankruptcy administrator, which means the reaching of the aim of bankruptcy procedure and best possible refund of the interests of all the creditors. But under the specific social backgrounds, there exists obvious defects and limits in the system of bankruptcy administrator in our bankruptcy law. This article tries to discuss the causes of them by examining the legal status and legal value of the bankruptcy administrator. Based on taking advantage of foreign advanced law making experiences, suggestions are rendered on the perfection of our system.
