Research On The Construction Of China's Institution Of Bankruptcy Administrator

As China's reform is deepening, and the market economy is marching gradually to a mature one, survival of the fittest is an inevitable outcome of market competition, and due to the promotion of socialist legal systems, more and more enterprises want to extricate themselves from the difficult economic position through bankruptcy, however, the legislation of bankruptcy is unable to meet the current needs, and caused some confusions in bankruptcy proceedings. It has become a sharp contradiction with the increasing cases of bankruptcy. Therefore, it's necessary to study all the relevant issues concerning the institution of bankruptcy, so I choose the institution of bankruptcy administrator as my topic and conducted a rather systematic exploration. The first part of the dissertation focuses on the concept and nature of bankruptcy administrator; it is theoretical fundamentals for later parts. The second part compared the institution of bankruptcy administrator in different countries, and it is used for references for construction of China's institution of bankruptcy administrator. In the third part, in order to perfect this institution, some realistic issues has been put forward by analyzing the defects of China's current institution of bankruptcy administrator in effect; the fourth part is the most important in the whole dissertation, bases on the above study of theoretical and practical issues, some suggestions which has significant realistic meaning has been put forward from five perspectives such as the position of the legal status of bankruptcy administrator and the establishment of such institution.
