Codes of conduct are, to some extent, a kind of self-disciplined promises, in which multinational corporations (MNCs) stipulate that all their contractors and manufacturers should abide by some labor standards. If they violate these Codes, MNCs will cancel the orders to them. Now China has been transitting to a"world factory"which provide the world with abundant labor force, MNCs implement their Codes which will put a great impact on Chinese government and Chinese society. making a preliminary analysis on this problem not only can enrich the substance of Codes research , but also has practical significance for labor protection , and China can use it for reference to deal with Codes on the background of economic globalization .There is essential antinomy in the process of implementing their Codes by multinational capital: on one hand, seeking for the most profits is the essence of the capital, on the other hand, MNCs restrict to exploit the labor excessly on their own initiative. Codes, therefore, put up the complicate character legally. Codes of conduct mostly adopt the Basic Labor Standard which is constitute by International Labor Organization, so that Codes protect the labor's right actually, although its original incentive is for profits. With the increasing of MNCs'investment in China, MNCs begin to implement their Codes and the scopes of implementing show a expand tendency. So the conflict and correspond between Chinese labor legislation and the labor standard of the Codes come into existence. How to deal with these problems which is the tasks Chinese government and Chinese labor legislation department should be face with.China, as a country that participate in international competitive mainly depends on cheap labor force, shows the austerity in the problem of labor protection. Codes exert the power which should be part of government's duty, together with exposuring some problems in the aspect of labor protection, which make the implement of Codes face with diversified oppugn and criticism. A basic fact, however, is ignored by all these voice of oppugn and criticism, that is, MNCs, as the uppermost propellent and benefitor in the process of economic globalization, will certainly take on some social responsibility on their own initiative. And that not matter a rule is national law or interior provision, it is impossible for all obligor of their own accord to follow due to diversified cause, the breaking of rules will occur after all.
