The compulsory education, which originated in European in the 16th century and matured in the 20th century, is a kind of common school education that provided by a country for the children in a certain age for a certain time and scope. During its long process of development, the scope of obligation subjects in the compulsory education has varied with the changes of age. In the modern right–oriented society , we must regard the children as the right owner and the society, schools as well as the parents as the obligation subjects .The compulsory education is a necessity to every citizen, so most countries generally have written it into their constitution as a kind of basic human rights .Every obligation subject must meet his obligation completely to make sure that every children suitable in age will enjoy his right .The reasons for which obligation subjects undertake their obligation in the compulsory education system is deduced from its necessity to the educates, the whole country and society . According to the relevant in the international human rights law, constitutions ,education law and compulsory education law , each obligation subject in modern compulsory education system undertakes his obligation in different levels. Among them, the country and the schools which extend country's function are the main obligation subjects .They undertake the most important obligation , while the other two undertake the less one . Because whether the obligation subjects undertake their obligation or not will affect the healthy development of the compulsory education system, in order to make sure every children in suitable age will receive high-quality compulsory education—the basic right stipulated by constitution ,we must establish some basic principles to supervise the obligation subjects to fulfill their duty .It's suitable and of great necessity to set"the greatest obligation in country principle","non-discrimination principle"and"children benefit maximization principle"as the basic principles. Nowadays the main problems in the field of compulsory education in our education include: high rate of school dropping out, frequent education discrimination , worsen education equilibrium and education quality bogged down. These problems mainly blame on the absence of principles for the obligation subjects to observe. To solve these problems , we must adjust the obligation among the subjects, establish the achievement and efficiency evaluation system to strengthen the supervision on the obligation subjects .Only in this way can we ensure the further development of our compulsory education . Recently in our compulsory education the situation that the body of obligation, especially the state and government usually do not abide their mortgage is very serious. This renders a series of problems: the frequency of discontinue students'study is very high, education is discriminated often; the balance of education goes badly gradually and the qualities stay stagnancy and so forth. To solve these problems, we should perfect related law and prove the achievement of governmental leaders'check system, establish the performance check system, and strengthen the judicatory protect of the right's body.
