The theme of this thesis is the duty of education and the Reasonable allocation of obligations in Compulsory education law.The Compulsory education has been in our country for thirty years since the Chinese first "Compulsory Education Law"promulgated and implemented in 1986.However,the field of compulsory education not only has made great achievements but also many practical problems and difficulties over the years.Furthermore,the quality education which has been suffering criticism by experts and scholars and the general public till now has not been tricking down to the ground yet.Under the influence of the college entrance examination baton,Examination-oriented education system has and having been intensified.In current Examination oriented education system,we have no choice but to adopt the teaching method of instillation.It is will not be conducive to the cultivation of innovative talents in the long run,for it is not only endangering national competitive strength,but also do irreversible damage to the growth of children.There were dozens of scholars trying to find a way to crack it and many books were written,but it was seems to have little effect.Through relevant literature review and research,the author comes to the conclusion that the essence of compulsory education in our country are inappropriate utilitarianism educational ideas that is to treat individuals as tools which is being uphold by the current compulsory education law,and our wrong understanding of rights and obligations.We should regard the people foremost and free and comprehensive development of human beings as the educational idea and goal of the compulsory education law.Once the educational concepts achieved its transformation,the subsequent operation is to provide the scheme for the reform of the current compulsory education law.It is the redefinition of obligation subject and re allocation of obligation appropriately of the Compulsory education.This thesis consists of five chapters.The first chapter is the introduction section.In this section,the author provides a Specific and concise interpretation of the choice of thesis topic of "The duty of Education and the Compulsory education:On the obligation allocation of Chinese compulsory education law",and of the significance of the research.Hence the author to challenge the academic viewpoint of the cognition of basic concepts of obligation and right in compulsory education law,of the definition of obligation subject,and of the academic ideas to regard the school-age children and adolescents to receive compulsory education as a right.Then the author to light up her own views that to accept compulsory education is not a right but an obligation to the school-age children,and to redefine the concept of obligations,rights and interests,moreover,to classify the relationship between them.At last,the author has done detailed descriptions about the research methods and ideas in the thesis writing,the difficulties in the process of writing and the innovation of the thesis.The author expounds the significance of education and the origin of compulsory education in the second chapter.This chapter starts from the source of Western Civilization--the education of ancient Greece and two different educational systems of Sparta and Athens are selected as typical representatives.Then the paper expounds the educational thoughts of Plato in Athens to illustrate the significance of Education.The initial education in Europe founded spontaneously by nongovernmental subjects.Until the religious reform movement led by Martin Luther,when Compulsory education was born in German,education has been controlled by the church since the medieval times.After that time,Britain,France,the United States and other countries have begun to follow the practice of compulsory education Of German,so far,the school education of modern significance has began to shape.The idea of compulsory education was introduced into China by Japan in the late Qing dynasty.Till now,it has gone through the enlightenment stage of compulsory education in the late Qing Dynasty,the development stage of the Republic of China and the popularization stage of new China.In 1986,China promulgated the compulsory education law and fully implemented it.In the third chapter,the author gave a detailed explanation about the outstanding problems in the implementation of compulsory education law in the contemporary China.These problems focus on the concept and objectives of compulsory education is backward,the basic conditions of compulsory education have limitations,unbalanced development of compulsory education,the management and guidance of compulsory education is weak,the internal effectiveness in primary and secondary school is low and the scientific research of compulsory education lags behind etc.The fourth chapter illustrates the theory which is used to guide the legal reform of compulsory education in contemporary China that namely the children's natural development theory of Jean Jacques-Rousseau,the Germanic auxiliary industrialization theory,Karl Marx's theory with regard to the free and comprehensive development of human beings,the people foremost theory and the theoretic of completing the process of building a moderately well-off society in all aspects in contemporary China.The author gives some countermeasures and suggestions in the fifth chapter.It is the reform Assumption of the compulsory education law under the guidance of the people foremost idea and the idea of the free and comprehensive development of human beings.Based on the previous chapters,we can see that the development trend of human education is the modernization of education.It is a trend which is from spontaneous education to voluntary education,from voluntary education to compulsory education,from the education in order to achieve the purpose of individuals acquire certain skills and of the state to achieve a certain purpose to the education for the free and comprehensive development of human beings.Thus the reform of the compulsory education law in the future should conform to the trend of the times,should to uphold the idea that the education should based on the ideas of people foremost and the free and comprehensive development of human beings rather than that the current utilitarianism educational idea which has been treating the educated as builders and successors of the socialist cause.Therefore,we should to redefine the obligation subject of compulsory education law and to reconfigure obligations of the new obligation subject.
