Research On The Legal System For China's Environmental Protection Industry

The historical, comparative and empirical analysis methods are used in this dissertation to give a systematic discussion on the following four aspects: a general survey of environmental protection industry, theoretical analysis of the legal system for China's environmental protection industry, the present situation of domestic and overseas legal systems for environmental protection industry and perfection of the legal system for China's environmental protection industry. This dissertation seeks to analyze the drawbacks of the present legal system for China's environmental protection industry and learn from the experience of the developed countries, and finally proposes measures to be taken for perfection of the legal system for China's environmental protection industry.The legal system for environmental protection industry is a basic rule, which must be obeyed by all during the course of development. It nails down the right and obligation of the subjects of environmental protection industry and ensures the establishment and smooth development of environmental protection industry. Since China is late in developing this industry and lags in researches as well, it is necessary for us to transplant experience of foreign countries, which are more mature in this field for the perfection of our own legal system for environmental protection industry.This dissertation can be divided into five parts.In the first part, a general survey of environmental protection industry is given. It is believed that environmental protection industry is different from ordinary industry by nature in terms of its connotation and property. It is pervasive, policy-guiding as well as for the benefits of public welfare.In the second part, a theoretical analysis is carried out on the legal system for environmental protection industry. The author mainly discusses the theory of the legal system for environmental protection industry and analyzes its jurispruden base, necessity and significance, among which high priority is given to the juridical analysis on environmental protection industry from the perspective of social law base and the balance of interest mechanism to seek for theoretical support.
