The establishment of the labor agreement system is a historic revolution in the history of the labor relationship development, which freed the laborer from the personal attachment relationship under the feudal system, thus superficially, the laborer became the independent subject who had the equal status with the employer in the labor force market. However, because of the nature of the attached relationship, compared with the employer, the laborer was in disadvantaged position, which made it impossible for the labor to struggle with the employer only by themselves. Thus the labor agreement was just the product of the employer' will and the status of two parties were hard to be equal. Eventually, to change this state, the laborer came to unite to form an organization -the Trade Unions. The Trade Unions represented the laborer to make collective negotiations and finally they resorted to the strike to force the employer to improve the working conditions and the living standard, which were set by the collective agreement. This is the Collective Bargaining System.In the western countries, the Collective Bargaining System plays an important and key role in adjusting the relationship between laborers and capitals, safeguarding the legal rights and interests of laborers and maintaining the social and economic stability. In our country, the Collective Bargaining System also exists, but for one reason or another, the common drawback is that it is devoid of content, as a result, the system does not give its play it can bring into. Among quite a few of the factors which influence the Collective Bargaining System, the author considers that the primary one is the imperfectness of the legal stipulation on the subject of the Collective Bargaining.
