The Research On The Subjects Of The Collective Agreement System

In western countries, the collective agreement system has been animportant system which can adjust labor relations, safeguard workers’legitimate rights and stabilize the social stability and economic order. InChina, there is also collective agreement system. However, for variousreasons, the collective agreement system does not play its real role andthere are many problems in it, such as going through the formality in thenegotiations, sounding vacant about the agreement and so on. I believethat the most important fact is the subjects of collective agreement systemthat is not clearly defined, out of adequate function, without perfect legalregulations. Therefore, this article is intended to analyze the subjects ofthe collective agreement system with the combination of China’s legalpractice and case studies, then make recommendations to improve ourcollective agreement system, and strengthen our collective agreementsystem function.This thesis firstly introduces the concept of the collective agreement system, introduced by the academic debates and case problems todemonstrate the subjects of the collective bargaining system. Secondly,analyze actual existing problems of three subjects in collective agreementsystem. That is lack of representation and independence of trade unions,employers not supporting the collective agreement, less negotiationparties at the industry level and region level and the lack of governmentalsupervision; based on the above study, there are following improvementrecommendations of the subjects in the collective agreement system: tosimplify the functions of trade unions, maintain the independence offunds in the trade union in order to ensure trade unions simply to protectlabor rights, the government should also play a right role in guiding,coordinating and monitoring the collective agreement subjects. Finally, tomake the "Collective Agreement Law", add other subjects in a higherlevel, make legislation about striking rights and other regulations onimproving the legislation of the collective agreement system.
