Research On The Issues Of Copyright In Digital Library

With the evolution and popularity of internet,research and development of digital library become more and more important.At present,the construction of digital library(DL) is very popular all over the world,which has become the new competitive factor of international high technology and is an evaluated symbol of national information infrastructure level. During construction of DL,it is confronted with a lot of challenges relating to society,economy and law,as well as technology.The core of DL construction is information resource,and during the process of information, the most important issue is the protection of copyrignt of intellectual property(IP).Digital Copyright becomes a problem which should be resolved eagerly in modern time.Comparing with the level of intellectual property protection in the advanced countries,there is a long way for China's legislation to go. With China's entry into the WTO, both opportunities and challenges exist for China's libraries. Concerning the issues of copyright,ways must be found for the survival and development for China's libraries.Faced with the trend of the extension of IP protection area,the internationalization of IP protection standard, the higher degree of IP protection level, how to get the laws and regulations of China into line with the international counterparts and how to effectively protect intellectual property rights from infringement, in addition to improving its networking and digitalization, is an urgent problem for China' s legislation of intellectual rights protection and library work .The paper is divided into 6 parts. Part 1 is the summary of function and characteristics of digital library. The paper begins with the presentation of definitions of digital library in different nations and international organizations, and its functions and characteristics ,then introduces briefly issues of the copyright relating to DL.Part 2 is about the current legislative situation of international protection of copyright relevant to DL.
