Study And Analyze On Problems Of Delivery Of Goods Without Original Bill Of Lading

Whether goods can be delivered without the original bill of lading is in issue nowadays. It is necessary to define Delivery of Goods without Original Bill of Lading and make clear its functions at different stages in international shipping and trade. The purposes of this dissertation is to make a basic interpretation of the functions of bill of lading and analyses of the causes of delivery of goods without original bill of lading and the obligations laid on the performers of delivery.The study of delivery of goods without original bill of lading shall be carried out as follows:(a) to make a basic interpretation of the functions of bill of lading;(b) to make a comparative analysis of the legal obligations (tort, breach of contract and so on) laid on different performers of delivery of goods without original bill of lading (such as carrier, actual carrier, their agents and other relevant persons) due to their different functions in the transportation;(c) to make a analysis of the pleas made by the defendants; and(d) to give some personal suggestions for the solution of the issue of delivery of goods without original bill of lading.
