Security Obligation In Tort Law

The appearance of the obligation of security on Torts means our legal system of Torts reaches a roughly high level , at the same time ,and has to face many questions when it is created .My dissertation makes a research on the concept and property of the obligation of security at first ,then borrows ideas from common legal system and continental legal system to analyze the structure and principles of it, and at last reach an aim to modify and perfect the obligation of security in torts in our own legal system.There are about 35,000 words with four chapters .Chapter 1 This chapter includes two parts .The first part mainly introduces the concept of the obligation of security. The second part will define the property and significance of the obligation of security by researching the sources of it.Chapter 2 It is about the background of the obligation of security in common legal system and continental legal system .Giving a comparative analysis between two legal system of the obligation of security, the origin, feature, and value will be discussed.Chapter 3 It will offer enough reasons to sustain the result when defendant breaks the obligation of security. Entering the liability stage, the author states the principle of liability and the relation of cause and effect in this chapter.Chapter 4 It is about the judicial interpretation about hearing personal injury . Besides this ,I will give some legislative advice of the obligation of security.
