Criminal Law Identification Of Several Crimes In The Process Of National Enterprise Reform

In recent years, market economy reform of socialism has been developed very rapidly in China, national enterprise reform is an important problem. Under the market economy of socialism circumstances, corporation ownership can improve the corporation's capability of competition and potential of human and money and property.Because the national enterprise reform is new, some problems inevitablely occurred. Some behaviors really are crime ,some belong to abnormal behaviors,not crime. How to identify these behaviors and punish criminals by criminal law is of great importance to the reform and development of market economy. This article provides general criminal law identification of related crime occurred in the process of national enterprise reform for reference.This article is divided into five parts.The first one is the purpose of writing this article.Chapter 1 introduces different ways to seize national property and corresponding criminal law identification.Chapter 2 introduces graft and corruption crime frequently appeared in the process of national enterprise reform. It clarifies that"a national enterprise"means an enterprise whose funds are entirely provided by the country. The object of graft and corruption crime is only the property containing public property and the property must be owned by the criminal's enterprise. The assets composed of an enterprise's property should been owned by the investor. Share can become the object of graft and corruption crime. When enterprise administration has changed registration of shareholders, graft and corruption crime is finished.Chapter 3 briefly discusses some problems not involved in criminal law.The final part gives a brief conclusion.
