Abstract/Summary:
The present paper discusses, respectively from three aspects, the legislation defects and the improvements of Law of the People's Republic of China on Protecting Consumers' Rights and Interests. Firstly, it starts with the basic legal principle of the protection of consumers'rights and interests. There is a difference between the broad sense and narrow sense of the law on protecting consumers'rights and interests. In the broad sense, it means an organic whole composed of all kinds of laws and criterions concerning the protection of consumers. For example, Basic Law on Protecting Consumers and other special and separate laws and regulations on protecting consumers, as well as the pertinent clauses and stipulations in other laws and regulations, all of them constitute an organic whole, which is the law on protecting consumers'rights and interests in the broad sense. In narrow sense, it only refers to Law of the People's Republic of China on Protecting Consumers' Rights and Interests, adopted by the fourth meeting of the eighth National People's Congress Standing Committee on 31st October 1993. This paper differentiates two basic concepts from the basic legal principle: consumer and consumers'rights, and secondly discusses the existing problems and deficiencies of Law of the People's Republic of China on Protecting Consumers' Rights and Interests in the adjustment scope. In this paper, some personal perspectives are presented on whether there should be the adjustments on Law of the People's Republic of China on Protecting Consumers' Rights and Interests in the new-style economic relations in the current society. It includes: 1, whether the medical treatment services are in the adjustment scope of Law of the People's Republic of China on Protecting Consumers' Rights and Interests; 2, according to our country's legislation and judicature practice, the real estate and public utility service belong to the consume in narrow sense, but Law of the People's Republic of China on Protecting Consumers' Rights and Interests doesn't adjust them; 3, the undertakers of such recreational activities as theatrical performance have the cheat behaviors; whether they are applicable to the Law of the People's...
