Reflection And Countermeasures On The Repetition Of Local Legislation

The problem of duplication of local legislation has a long history,with the expansion of local legislative power performance more prominent,has become a barrier to the construction of the legal system in China.The amendment of the Legislative Act of 2015,which gave legislative power to all municipalities divided into districts,had a great impact on the construction of local rule of law.On the one hand,the expansion of legislative power has facilitated the improvement of local legislation,on the other hand,it has made the duplication of implementing legislation increasingly serious.The repetition of local legislation is not only reflected in the legislative style,but also in the content of the legislative text.Thus,the legislative authority is damaged,the cost of legislation is increased,and the quality of legislation is reduced.This is Through the empirical analysis of the air pollution prevention and control law and its related local laws and other local laws and regulations,this paper draws the conclusion that the repetition of local legislation is mainly the repetition of the upper law.There are many reasons for the duplication of local legislation,such as the lag of legislative orientation,the utilitarian purpose of legislation,the outdated concept of legislation and the lack of legislative supervision.In view of the causes of duplication of local legislation,this paper puts forward the countermeasures of duplication of local legislation.It is mainly divided into two parts: coping concept and coping measures,and coping concept has careful legislation,scientific legislation and innovative legislation.Among them,scientific legislation is the key point,scientific legislation not only requires scientific ideas,but also in legislation.
