Without life, we have nothing at all. The right of life is the source of all human rights as well as the foundation of all rights. Without the right of life , any other rights can nether have the significance nor be able to exist. The right of life lays the foundation of the system of human rights. It is the first right and the most important human right. China doesn't have the legal tradition just as the western world does that regards human life as the air expanding to each domain of social life, look upon human life as the highest value and makes different policies and different laws with the idea that life is the most sacred. Therefore we should strengthen the protection of the right of life through the legislation.This article is composed of four parts. The first chapter is the ontological research of the right of life. First, the article carries on to the concept of life. In the legal area, life does not refer to the life of all life-forms, but only refers to natural human being's life. Life starts with birth, whose judgment standard is'the independent breath theory'. Life ends in the death, whose judgment standard is the three symptoms theory which means life ends with the beat of hearts and irreversible breath as well as the dilation of one's pupils. Secondly, the article gives a definition of the right of life. Through the comparison of different viewpoints, the article draws to the conclusion that the right of life is a right that takes natural person's safety benefit as the content.
