Research On Legal Issues Concerning Recall System Of Defective Products

It has important significance to set up the recall system of defective products. A lot of countries and districts have already established recall systems of defective products since 1960's, which includes many products, like automobiles, foods, medicines, etc. But until March 5, 2004, China issued"The Recall Management Regulation on the Defective Automobile Products", which has begun to implement from October 1, 2004.Based on the regards of foreign advanced experiences, combined Chinese national conditions, adopted comparative methods, the dissertation focuses on the problems in recall system of China. Based on the above-mentioned thinking, the full text is divided into five chapters and describes this question altogether, about 45 thousand words. The part of the foreword introduces the backgrounds of the appearance of the recall system in China.Chapter one elaborates the important significance of establishment of the recall system in China, and then points out that the recall system is very important to customers'interests, companies'interests, product duty insurance, environmental protection and public interests.Chapter two analyses the basic issues in the recall system. Through analyzing the meaning of recall, defect of product and defective products, the meaning of the recall system is defined. And the differences between the recall system and other relevant concepts are made clear.Chapter three analyses the legal source of the recall system. Many vital issues must be re-considered. Then the next two chapters embody the concrete contents.Chapter four studies the entity part of the recall system, investigating and drawing lessons from the foreign advanced experiences.
