The Safeguard Of The Victim's Right In The Criminal Litigation

In the criminal litigation of China, the victim is taken as one portion, however, the legislation is very ambiguous and defective concerning the range and content of its right, thus resulting in obvious imbalance comparing with the judicial position and right of the injurer. In the practice of legislation, the right of victim is often seriously violated, in many countries in the world, especially the western developed countries, the right of victim is protected comparatively more completely. Of course we also made so much progress, but it is far from enough, and still quite distant from the western developed countries. For emphasis of the ultimate aim of legislation justice, the embodiment of humanitarian and judicial care of socialist countries, shortening the distance from the international standard, it is very urgent and necessary to enhance the protection of victim right in China, and some further measurements should be taken accordingly.
