Comparative Study On Regional Trade Arrangements' Dispute Settlement Mechanisms

With the development of regional trade, regional trade disputes increase gradually. So the establishment and improvement of regional trade dispute settlement mechanisms become one of the most important content within world trade area.This article describes the value and the developmental trend of RTA and analyses its position in WTO legal system. After that, the article indicates the necessity of establishing RTA dispute settlement mechanisms and discusses several important RTA's dispute settlement mechanisms. The core content and innovation of this article is to do a overall comparison between WTO's dispute settlement mechanism and RTA's dispute settlement mechanisms. By doing such comparison, this article shows the conflicts between such two kinds dispute settlement mechanisms and suggests some methods to solve them .China has been actively participating RTA practice and benefits a lot from such arrangements. In the end, with the perspective of the practice of Chinese RTA dispute settlement practice, this article presents some suggestions. These suggestions are presented to construct and improve the dispute settlement mechanisms which China currently takes part in. The author also hopes that this article may be helpful to Chinese future regional trade practice.
