Study On Sunset Review Of Anti-Dumping System

When a country's antidumping measure expires after five years, the department in charge will determine whether it needs extension through sunset-review procedures. If previous antidumping judge is the start of the game, the sunset review will be the sticking point of determining the continuation of the game. Since WTO formally confirmed the Antidumping Agreement in 1994, member countries stated amending their antidumping laws one after the other to introduce or consummate their own systems, among which USA and EU feature their antidumping measure with the completeness and respective traits. Although there also are related sunset review items in China's present Antidumping Statute, they are relatively simple and incomplete. With increasing attention paid to the sunset review in the global environment, our country should summarize the past experiences and learn the mature legislation from USA and EU to establish the applicable operation rules of sunset review procedures and direct antidumping operations. This paper consists of four chapters, and focuses on the sunset review procedures of USA, EU and WTO using comparison method. Based the results, this paper proposes countermeasures for China's corporations to answer the foreign sunset review procedures and suggestions for establishing our country's sunset review systems.
