Research On Standard Form Clauses In Consumer Contracts

Along with the development of the economy, the nasty play of the trade amount growth, standard form clauses have already been full of our economy life in many ways. Bank, insurance, transportation, water and electricity supply, the retail business, service etc. profession, all are using standard form clauses broadly. The usage of standard form clauses raised the economic efficiency, economize to trade the cost, but also brought the juridical problems. These problems, in consumer's rights and interests, are how to rule standard form clauses according to the law, how to raise the economic efficiency with maximum limit, and then can protect consumer's rights and interests. This is the reason why I write this article. On the foundation of others' research outcome and methodology, combined the theories and reality cases, this article tried to do some research on standard form clauses in consumer contract. This article concerned five aspects of the standard form clauses in consumer contract, from the concept of standard form clauses, the gains or losses analysis, standard form clauses into the consumer contract, interpreted of standard form clauses, affirm the validity of standard form clauses, the law rules system of standard form clauses etc. Textual study is mainly for purpose of judicatory practice, and lays particular emphasis on the research of law application.
