Research On The Regulation Of Standard Form Contracts In China

In the modern economy, most people realize the transaction through the contract.With the development of economy, the scope of standard form contract is more and more extensive, now the standard form contract has become one of the most important ways of contracting. With the wide application of standard form contract, it is active in social and economic subsistence, at the same time, a lot of outstanding contradictions and problems appear in the course of development. In the developed countries or area such as Germany, British and Taiwan Province of China, the regulation of standard form contract have accumulated abundant experiences. So it has worth to be reference of mainland China. Therefore, there is an urgent need to improve the regulation of standard form contract in our country and makes sure the good order of economic.The thesis is divided into five chapters: The first chapter is the introduction. This part describes the background and significance, analyses the status of domestic and foreign academic studies and introduces research methods and the major innovation.The second chapter emphatically summarizes the basic problems of standard form contract. It mainly includes the concept and legal characteristic of standard form contract, the cause and values, developments and applications of standard form contract in China. The third chapter throws light on the overseas regulation of standard form contract, mainly about Germany, British and Taiwan Province of China.Then the author summarized the respect which is useful for our country. The forth chapter analyses the regulation of standard form contract. This part mainly consists of two parts: the current situation and problems of standard form contract in China. The fifth chapter offers new proposals for the thesis, including with legislation, judiciary,administration and social regulation. This thesis final provided innovative proposals on the practical legislation of format contract to promote the regulation of standard form contract in China.
